Professional executor consulting with clients about the role of an executor of an estate and estate administration

What Your Executor Will Actually Do

Appointing an executor of estate is one of the most important decisions you will make in your will, yet it is often done without a full understanding of what the role truly involves.

It is More Than Reading a Will

Many people are surprised by the role of an executor of estate. It involves far more than simply reading a will. It is a significant role that often takes many months, and sometimes considerably longer.

The duties of an executor are to:

  • Manage the full estate administration process through the Master of the High Court
  • Gather and organise important documents, including a full record of assets and liabilities
  • Settle outstanding debts and ensure all financial matters are properly finalised
  • Engage with SARS to complete all tax requirements
  • Protect and manage estate assets until they can be distributed
  • Communicate with banks, insurers, and other institutions
  • Guide your family through what can be a complex and emotional time
  • Mediate with family members where needed

This role requires time, care, and attention to legal and financial responsibilities. It is not something that can be handled quickly or without experience.

Choosing the Right Executor of Estate

At Marsh Fidelity, we encourage clients to choose someone who is genuinely suited to the responsibility, not simply someone who feels obligated to say yes.

The right executor is someone who is:

  • Organised and reliable
  • Fair and level-headed, especially in family matters
  • Financially and legally aware
  • Available to commit the necessary time
  • Trustworthy and able to carry out your wishes faithfully and independently

Appointing a family member may feel like the natural choice, but it is not always the most appropriate one. Many family members feel obliged to accept the role, even when they do not have the time, experience, or practical knowledge of deceased estate administration. Where the executor is also a beneficiary, this can create additional complexity. Balancing personal interests with the duty to act impartially may lead to tension or conflict within the family.

“The right executor is not necessarily the closest person to you – it is the one best positioned to serve your estate and your loved ones with care and impartiality.” Daniel Marsh

Plan Ahead

It is helpful to speak to your chosen executor of estate while you are still alive. Ensuring they know where your documents are and understand your wishes can make the process significantly smoother for your loved ones – removing uncertainty at an already difficult time.
